Using Firefly AI Assistant Beta for final production and I Indemnification

If indemnification is material to a business decision, my recommendation is to seek advice from your own legal counsel and to engage directly with Adobe through your account team.

With that caveat in mind, there are three important points to be aware of based on Adobe’s publicly available documentation.

First, Adobe’s IP indemnification is available to enterprise customers only. It requires purchasing a specific entitlement through an enterprise contract and is not included in individual or teams plans. Second, beta features are explicitly excluded from indemnification. Adobe’s own product description states that indemnification excludes “any features designated as ‘beta’ or ‘trial’ or accessed within a surface labelled as ‘beta’ or ‘trial’.” As the Firefly AI Assistant is currently in beta, it falls outside the scope of indemnification even for enterprise customers who have purchased the entitlement. Third, regarding partner models: Adobe’s documentation states that enterprise customers are eligible for indemnification for outputs generated by Adobe Firefly, Google, and OpenAI models, subject to terms. Other partner models such as Runway, Kling, and Black Forest Labs are not covered. However, as noted above, the beta exclusion in point two takes precedence regardless of which model is used while the Firefly AI Assistant remains in beta.

Regarding credits not being consumed: Adobe's Firefly AI Assistant FAQ confirms that during the beta period, entitled users receive complimentary daily credits to use exclusively on Firefly AI Assistant, which do not draw from the account's ordinary Firefly credit balance. The absence of credit consumption does not indicate any additional IP protection or commercial clearance.

For production assets requiring IP indemnification, Adobe has recommended using the non-beta Firefly native model features covered under an eligible enterprise plan.
