I purchased a copy of CS2 used, I am unable to get it activated.

The upgrade that I purchased came with the serial number and everything. I am able to upgrade my Photoshop 7 to CS2 but I cannot get it activated. I tried the online activation and I get

"Activation server unavailable: Activation was unsuccessful"  24:24

I tried calling in and doing the telephone activation and the number is out of service.

I have read that if the previous owner did not deactivate their copy that it could cause some issues, the problem with that is they could not deactivate their copy because they purchased an upgrade to CS5 that they applied to their CS2. Am I out of luck here?
