Mute Button staying on or randomly coming on in Timeline

This has been discussed that I know but this issue is as everyone agrees frustrating.

Here is the simple version of what is happening.

At the beginning I must have muted the audio track to do a voice over.

I now find that the Mute Button want to come on in certain areas.

If I go to the start of the sequence The Mute Button is ON in the Background Music Track

If I slowly scrub through moving the Playhead it comes off after about a second or so, BUT

If I hit the space bar to start Play it stays on until I press the Space bar again to stop the play or hit the Mute Button OFF

Also you can have the Mute Button On in the Background Music Track but it stays on in the Audio Track Mixer?
