Commercial Use of Free Adobe Firefly Generated Images for Marketing

Hi Firefly Community,

I'm relatively new to Adobe Firefly and have been thoroughly impressed with the creative possibilities it offers.

 

As I explore using Firefly more in my work, a significant question has come up regarding the usage rights of images generated through the free tier. Specifically, I'd like to know if images created without a paid subscription (i.e., using the free credits or generations) can be used for marketing purposes.

My main concerns are:

  • Commercial Use: Is it permissible to use these free-tier generated images in advertisements, social media campaigns, website content, or other materials intended to promote a business or product?

  • Attribution Requirements: If commercial use is allowed, are there any specific attribution requirements to Adobe Firefly or the AI itself that I need to be aware of?

  • Licensing Implications: Are there any licensing restrictions or terms of service that might prevent or limit such marketing applications for free-generated images?

    I've tried to look through the official documentation, but I'm finding it a bit unclear on this specific point for the free tier.

    Any insights or definitive answers from experienced users or Adobe staff within the community would be incredibly helpful. Clarifying this will allow me to plan my marketing strategies effectively and ensure I'm compliant with all terms.

If you need to make commercial decisions based on the use of a specific tool and have intellectual property questions, the best resource to use is an attorney with expertise in contacts, licence agreements, and intellectual property issues. I am not an attorney, so I am only providing guidance from my point of view and not providing legal advice to you.

 

Please note that Adobe has terms of use which include guidance on commercial use of Firefly generated images.  Tho

Please note that Adobe has terms of use which include guidance on commercial use of Firefly generated images.  Those are detailed in these documents:  Adobe Generative AI User Guidelines and Adobe Generative AI Additional Terms. You should also consult Adobe General Terms of Use.

 

Note that today, there does not appear to be any differentiation between the free tier and paid tiers and how the images can be used. It used to be that the free tier had a visible watermark in the lower left corner and the terms of use indicated it could not be removed. That watermark is no longer added to free tier generations.

There does not appear to be any restrictions on free generations beyond the ones on paid plans (such as you cannot use them to train other AI models).

There is no attribution requirement.

I refer you to section 5.1 of the Additional Terms document. That appears to be the most significant difference between free and paid plans and might have a commercial impact on you.
