Firefly generated images as Open Educational Resources with Creative Commons Licence

Hello Adobe Firefly Team,

 

is it possible to use Adobe Firefly Images as Open Educational Resources with a creative Commons licence

 

For example, I am a lecturer at a university and want to create a digital educational excape game for my students. I use Adobe Firefly to generate Images for the digital content of the escape game. I want to share my work with other lecutrers as Open Educational Resources and apply a https://creativecommons.org/licenses/by-nc-sa/4.0/ Licence to the Firefly images.

 

Would this be possible? In the Terms, it is stated that the images are limited to non-commercial purposes.

@hplpunkt I'm just seeing your question and wanted to make sure you got your answer. When you first asked this question Firefly was still in Beta, which meant that you could not use any Generations for commercial use. 

We are now out of Beta so you should be able to use images Generated for commerical use unless otherwise specificed. Read more here: https://helpx.adobe.com/firefly/faq.html#using-firefly

Hello CMass,

 

thanks for your answer. Has anything changed since the release in september? I can't find any detail in the links you provided.

My institution has licenced Adobe Firefly as a part of the CC Cloud. So I still have the question, if I can use my Adobe Firefly Images (created with credits) as Open Educational Resources with a creative Commons licence? It would be helpful, to know it it is permitted and what kind of CC-licence is permitted (e.g. CC BY-NC-ND https://creativecommons.org/licenses/by-nc-nd/4.0/ would limit the use to non-commercial and would not allow further edits).

 

This is important to us, since we are creating content in education where it is sometimes required to publish the work as OER.

@hplpunkt Thank you for your patience. Adobe can't advise on use of specific outbound licenses with Firefly generated content. You will need to check with your organization's legal team to ensure that it complies with Adobe's terms.

Same question here. My university has even contacted Adobe to ask this question in an official capacity and no one has bothered to respond. My team is now considering moving away from Adobe products as a result, since we make OERs and we can't get an answer.

My institution has also reached out officially, and there is not clear response. Firefly has given us the opportunity to include more diversity in our images of people in resources (something we're so excited about), but we can't get any answers on whether we can use them in OERs.  The next step for us would also be using different tools.
