Is that a paraphrase or a direct quote? Are you in a different language area?

On the page I see, it says:

"However, if Adobe designates in the product or elsewhere that a beta version of a generative AI feature cannot be used commercially, then the generated outputs from that beta feature are for personal use only and cannot be used commercially."

https://www.adobe.com/legal/licenses-terms/adobe-gen-ai-user-guidelines.html

Adobe has not designated that the feature cannot be used commercially

It is available for commercial use now.

There is no specific timeline for the end of its 'beta' period.

In the Adobe User Guidelines it says, "If you are using generative AI features that are a Beta Version of our Services and Software, you may not use the Output (defined below) for any commercial purpose." We are using the paid Creative Cloud 28.0 Adobe Illustrator but the Text to Vector feature itself is Beta, so that's where the question arose.

Adobe has not designated that the feature cannot be used commercially. In the user guide, it explicitly states the opposite:

"Text to Vector Graphic is available in the Illustrator app wherever Adobe provides services, except in China. It's designed to be safe for commercial use.

I clicked on the first link you provided and then the link in the first paragraph that says Additional Terms. Thank you for providing the second link, that helps clarify it for me.

I think there is still potential for confusion here. I'm not sure I understand the reason for differences between these guidelines and terms of use. @Anshul_Saini perhaps you can clarify?

The Adobe Generative AI Additional Terms state:

"If you are using generative AI features that are a Beta Version of our Services and Software, you may not use the Output for any commercial purpose."

https://www.adobe.com/content/dam/cc/en/legal/servicetou/Adobe-Generative-AI-Additional-Terms_en_US_...

This sounds pretty clear-cut. 'Text-to-Vector' states it is a Beta feature, and these terms state that you cannot use the output of beta AI features for any commercial purpose.

However, the Adobe Generative AI User Guidelines state:

"However, if Adobe designates in the product or elsewhere that a beta version of a generative AI feature cannot be used commercially, then the generated outputs from that beta feature are for personal use only and cannot be used commercially."

https://www.adobe.com/legal/licenses-terms/adobe-gen-ai-user-guidelines.html

This seems to add a caveat to the terms: the output cannot be used commercially if the feature is Beta and that Adobe designates that it cannot be used commercially. Why is this caveat not in the Terms?

The user guide page for Text-to-Vector states:

"It's designed to be safe for commercial use."

https://helpx.adobe.com/uk/illustrator/using/text-to-vector-graphic.html

This is not a legal document or usage guidelines, nor does it state that the feature can be legally used commercially -- just that it is designed to be safe for commercial use. A feature may be designed for a purpose, but still not be legally available for that purpose. But it is obvious that a user would interpret that as meaning that it can be used commercially, without the page giving further qualification.

Here are the main changes and additions in the Adobe Generative AI Additional Terms effective as of April 15, 2024, compared to the previous version effective from September 8, 2023:

The old one: Adobe-Generative-AI-Additional-Terms_en_US_20230908.pdf
The new one: Adobe-Generative-AI-Additional-Terms_en_US_20240415.pdf

1. Removal of "Beta Versions" Section

The section that restricted commercial use of outputs generated by Beta versions of the generative AI features has been removed. This suggests that the previous limitations on using outputs from beta features for commercial purposes are no longer explicitly stated.

As I understand it, we can now use beta version features for commercial purposes, unless Adobe explicitly designates certain features as not for commercial use. Is this correct?

LATEST

Please note the recent updates to Adobe's Terms of Use as of June 18, 2024. The modifications are significant, particularly concerning the use of Text to Vector features for commercial purposes. According to the latest terms, there are no restrictions on the commercial use of these features.

For detailed information, please refer to the following links:

The Generative AI User Guidelines specifically state:"These Generative AI User Guidelines (“Guidelines”) govern your use of Adobe’s generative AI features. In addition, if your agreement with Adobe is governed by the General Terms of Use located at adobe.com/go/terms, then your use of these generative AI features is also governed by the Adobe Generative AI Product Specific Terms located at adobe.com/go/adobe-gen-ai-addl-terms, which are incorporated by reference into these Guidelines."

In conclusion, you can now use beta version features for commercial purposes unless Adobe explicitly designates certain features as not for commercial use. As The Generative AI User Guidelines specifically state : "

8. Commercial Use

In general, you may use outputs from generative AI features commercially. However, if Adobe designates in the product or elsewhere that a beta version of a generative AI feature cannot be used commercially, then the generated outputs from that beta feature are for personal use only and cannot be used commercially."
