Underline blocked by the shading of the next paragraph

So this is what I'm trying to do (HEADER in another text frame in this sample):

I use underline with a custom stroke for the circles, shading for paragraphs below. When I try to put them in one frame (moved the baseline of HEADER), it's like this:

Is there an easy way to make it, without using anchored object?

Since there is no way to change the build order of objects, one suggestion: if your paragraph shade is a tint of the same colour for the "HEADER" dots in all cases, try apply the Transparency Effect "Darken" to the paragraph shading. This would of course only work properly if the background was white behind everything.

Actually, I later realized this won't work, so ignore my suggestion. (I realized there's no way to make just the shading "Darken", it would apply to the whole text object... not what you want). Uwe's idea is the best.
