Part of my photos are missing in LR5 

In library mode as well in the development screen the top is missing.

Then again it is there again when exporting......

You are using an old version of Lightroom on an unsupported OS, so the Info overlay, which should have a transparent background, displays with a grey background.

Press the I key on your keyboard once or twice to hide it.
