For what it's worth, you can totally avoid this bug by using File > Export > Export As. I just checked it and that workflow does NOT set the flag after saving to JPG.
I think it's an erroneous alert (PS flattens the images to save a JPEG). You can clear all all warnings to remove the alert. I'll log a bug and see if it's an easy fix.

Thanks for looking at this, Jeffrey. This is actually a fairly significant issue for many of us since it's impossible to track whether the warning is valid or not. All too often we're running batch scripts on files and not paying any attention to the layer comp panel.
Also, this is only when saving a flat jpg out. If i save a flat copy using any other file type, the layer comps are unaffected.
