Intellectual Property Removal --- Counter Notices and Objections.

If you have legitimate proof of ownership and are contesting a take down order, you must submit it directly to Adobe.  Use their online form, fax or physical mailing address.  Counter Notices will not be accepted through other channels.  See below for details.

Dear Adobe Support Community,

 

I wanted to reach out regarding an issue I've encountered with my account. Approximately one year ago, I uploaded a simple vector design in an EPS file format, which Adobe accepted without any problems. However, just two weeks ago, I received a notification stating that my account has been banned due to alleged intellectual property infringement related to that file.

Naturally, I immediately reached out to Adobe's care team and provided all the evidence I have in a Google Drive file. Despite this, I received another message today requesting further information.

Here is the message I received from Adobe:

 

"Dear Basit Ghani,

We acknowledge receipt of your notice. However, we are unable to take action as we are missing some critical information.

In order to process your notice, we kindly ask you to verify your authorization to report the content.

For such purposes, please provide appropriate evidence of your authorship and/or authorization to distribute & license the file(s) in question. Sufficient documentation may be provided by the RAW-files of original photographs, source-files of more complex work-types, or by showing a signed copy of a corresponding license agreement with the original rights owner. It is critical that the creation date is visible from such documentation.

Thank you for your cooperation & understanding of our diligent process of assessing copyright infringement.

Sincerely, Adobe Intellectual Property Agent"

 

I am at a loss as to what further steps I can take to resolve this matter. I have already provided what I believe to be comprehensive evidence of my ownership and authorization to use the file in question.

If anyone in the community has experienced a similar situation or has any insights into how I can proceed, I would greatly appreciate your advice.

The evidence that you presented to us in your Google Drive does not prove that you are the author of those data. They will need anything that proves that you did the authoring of those assets. As they are vector files, you surly can't provide raw files, so you need to check what else could help Adobe to understand that you are the author of said assets.

I am writing to inform you that my Adobe account has been blocked. I have sent several emails to the Adobe Care team but have not received a response. I believe that my account has been blocked due toalleged intellectual property infringement, but I have evidence to prove that I am innocent. Can you please advise me on how I can submit this evidence to Adobe?

You are not addressing Adobe directly in this forum, which is primarily supported by fellow Stock Contributors.

 

In addition to content ownership, there are other reasons for triggering a refusal based on IP infringement, including recognizable people, logos, protected designs, trademarks, names, etc.  Certainly, your argument that you have posted the same assets elsewhere is not a valid defense against an IP refusal. In general, Adobe provides no avenue for you to dispute the findings of their Moderators, other than this forum in which you can upload the refused images for further input from other Contributors.

If your account has been suspended, there is nothing that this community of peers can do for you. You will need to contact Adobe contributor support via the link at “Contact us”. Adobe will answer via e-mail, so watch your spam folder. The answer may take some time, depending on the workload of contributor support and the complexity of the investigation. So be patient and do not spam the contributor support.

 

You have to wait for their answer. We won't be able to help you, and therefore I'm locking this thread now. And yes., it's probably because of your violation of IP. It appears that Adobe has a different view on what you have sent in.
