Printing on demand with just one license?

So, an online-shop that sells posters and other print products bought an extended license for one of my photos and put it into their shop.
I happen to know, that this shop is printing products on demand, as the orders come in. I once was a direct contributor in that shop and earned 15% of every sale of my photos. Then they kicked me out and bought one of my best selling pictures with extended license to sell it themselves.

But they are not allowed to do that, right?
Because every order, would require a new license, since it's always a new customer/client.

It would be okay, if they produced a large amount of posters and sell those to different customers, but can they really print as many copies on demand with the extended license?

It is allowed with an extended license. It is also allowed with API partner sites. Customers are allowed to make a one time print for personal use with the standard license. A customer can purchase a standard license on behalf of one client. The API partner purchases a standard license for a one time print for personal use on behalf of their client.

Looking at the short of the terms you have this:

  • Asset may be featured in merchandise or products for resale.

In your case, the product is your picture. They don't sell paper. They sell a picture. So I suppose they would need a different kind of license.

That's what I thought...

Otherwise, that would mean, I can buy ONE extended license for an image and use it for as many clients and on as many different products as I want, whenever I want and forever...

If it's a poster, a website, a handout, a coffemug... Whatever. No need to ever buy any license for that image again.

Correct?

An Extended license purchase does allow an image to be used an unlimited number of times on a product such as a poster.

What you are referencing about purchasing a new license each time a product is ordered is the Partner API program which does not require an Extended license.

OK, the shop is putting this on-line (or off-line) and each time a customer knocks on their door to get a print, they print on demand a poster.

Is that allowed with an extended license? And if not, what could the rights owner do? How does he appeal?
