Fiverr seller reselling logo

Hello,

 

I ordered a custom logo on fiverr to use as my company logo, i quickly realise the seller wasn't designing, he just resell files or re draw logos found on adobe stock and other websites. What can i do about that ? I read the terms of use of adobe stock and it is clearly stated that a logo can't be reselled as a business logo because of copyright infrigment, and if he's not an adobe stock user he's clearly doing plagiarism. i have proofs of stolen logos if needed.

If this is a question about Adobe's terms: as I understand it, the seller would not be allowed to simply take a stock picture and sell it to you. But they can use stock pictures as part of their design. They would also need to license a new copy for each client for which they use it. I don't know if that helps.

Yes they can use the stock pictures as part of the design, but it can't be more than x % parts of the design i believe, in my case it's way worse he/she tried to sell me a logo as i ordered a custom logo for my business, that completly infrindge adobe's terms and copyright as they can't sell the logo to a company to use as a trademark they can't even make a design with stocks if the client will then sell stuff with the design printed on it due to copyright too.

You purchased a logo from elsewhere? How does Adobe figure into this exactly?

I don't know i'm just asking, someone try to sell me logos found on adobe stock so maybe its one of adobe stock users clearly infringing adobe stock term of use, and if not it's clearly plagiarism of said content. Adobe doesn't care of copyright or terms of use infrigment ? just asking. I though people doing that would face repercussion.

You need to consider several points:

  • The seller may be the original creator of the asset. Contributors are free to sell their assets also on other platforms.
  • You need to confront the designer with your findings. It may well be that it is the contrary that someone is using the creator's designs.
  • If there is a (c) infringement, you will have to alert fiverr and ask for a refund.
  • As long as the ownership is not cleared, I would counsel you not to use the logo.
