My background is still and my subject is moving, is there a way to mask the background to remove it since it is standing still. You know, instead of doing that brushing method??

I have the newest CC version of AE on windows 10.

I think Mylenium has probably hit this but what you are describing seems to have little to do with the background at all.  If I'm understanding you correctly, all you are really asking is how to remove the moving person from the background?  The background being still offers no advantage as the person is moving against it.

Naturally, that means a roto of some sort.  Do you have the clip?  Curious how complex it is.

You can take any empty plate and use the color differences to pull a key of the person moving around in the shot as Mylenium mentions. However, that requires a much higher color fidelity than most cameras create. If the files are compressed (like from a DSLR and most prosumer camcorders), it's likely not going to work well.
