Hi, I have a question with commercial use of work done through Photoshop (Beta)/ Generative fill.
I have created through Generative fill more background to an image and I would like to know if I can use it for commercial purposes.

Hi all, Ps beta and GenAI use will not be changed as far as commerical use, if customers want to use GenAI for commercial jobs, they will need to use the general release of Ps: Adobe Photoshop Version: 25.0.0 20230906.r.37 b14e317 x64

I guess now the question is, will clients be willing to pay for content created with GenAi if it is not copyrightable? Will we, as commercial artist be content with creating Ai content that can be copied and repurposed without repercussion?

My guess is copyright attorneys are going to be very, very busy in the very near future. AI has changed the nature of creation and ownership. And as with other new media technologies, for good or ill, there is no turning back from this change.

Hello, I updated to this version 25.0.0 and the user agreement says clearly it can NOT be used for commercial use in the betas, but why state this in the commercial version? Is confusing 🙂

Try Gigapixel AI.
In my experience it has had some impressive results in increasing higher image resolution from a 1024px x1024px 72dpi images.

What confuses me is that I'm seeing lots of Ai generated content on Adobe Stock. Any of these images (which are clearly made for commercial use, as they are on Adobe's own licensing platform) could have been made using GF in Photoshop. I just need quick access to a (legal!) photo for commercial use for a class I'm writing. It seems I can't use Photoshop to create my own image quickly, but I also can't count on licensing sites to be legal either, as so many of the images are now made with GF. Any thoughts or tips are appreciated.

@Elle32424771bhhc with the release of Ps 25.0, NON beta, GenAi is available for commercial use as Ps has always been. There are no restrictions in Ps on its use so there is no need to be worried. If we didn't understand the question, please let us know. To make it as simple as possible, if you use GenAI that is now available in the public release version of Ps, you can use it for commercial use, no issues.

Example 1: We use our own image as a base, and add AI imagery and effects.
Example 2: We create a full GenAi image from our own imagination and prompts.

Not everyone lives in the USA.
What is the Adobe view/rule/guideline.
I'm in Canada, people all over the world are using Photoshop with AI generated content. How are creators supposed to know what they can and can't copyright, when with the interenet we can sell worldwide.
This is why I want to knew specifically, what Adobe recommend.

In addition, after taking a look at the ai_policy_guidance.pdf, it would appear that the US are leaning towards a creation being copywritable if it includes some sort of human centered creation ability. So it seems a case by case basis. Thinking of that idea if all countries adopted a similar take on things, it seems that a creator is able to copyright, and maybe moreso in the case of having an origianl work and adding AI elements to it.
I guess this will be an evolving process.
