OpenGL error, cannot use rotate tool, Macbook Pro M1 max

When I first open any document I CAN rotate the canvas normally as long as I have not made any changes.  After making a new layer or turning any layer on or off, I can no longer rotate and get the error message:

"Could not complete your request because it only works with OpenGL enabled document windows"

If I open a document, rotate it to an angle, then make a new layer, the instant the new layer is created the document will snap back to its regular orientation and the rotate tool no longer works.  

 

 

My system:

Macbook Pro M1Max

OSX 12.1 (no available updates)

Photoshop 23.1.0

Use graphics processor is turned on. I have also tried it turned off, same result.

Could you try running Photoshop under the Rosetta emulation mode and see if it helps? https://support.apple.com/en-us/HT211861

Enabling Rosetta emulation did not work.

I installed Rosetta through terminal because I had not been prompted by any application previously.  Install was successful.  I enabled rosetta in the info window for Photoshop.  I verified that there were no updates available for photoshop or osx and restarted.  The problem persists.
