Licencing for Banners

Hi, we plan to use an Adobe Stock images insertet into a marketing kit for a non-commercial federation website, a client of us. In this marketing kit will be a banner, created by our graphic designers, using an Adobe Stock image. The banner shall be used on websites of the federations members, aprox. 20. They should present this banner on their websites in order to guide traffic to the federations website. The use of the banner will be free for the federations members, in the sense that nobody pays anything for it.

Can we use Adobe Stock Images in that way? Is an Extended Licence for the federation  the right one? Or do I need 20 Standard Licences for each of the federations members?

First: There is no difference if it is for free or paid for...

Second: if I understand right you are creating a publicity banner for the federation that the members show on their website. The owner of the banner is the federation and when the federation wants to change the informations that is on the banner, the federation does that and the members show the new information... In this case the federation needs to have a standard license.

If however each member is showing a customized banner and the member decides on the information shown, he will be the final licensee of the banner and each member needs a standard license.

An extended license would not help here, IMHO, as you are not producing a good for sale where the only incentive to buy the good would be the licensed picture.

(Disclaimer: As always with licensing, this is my interpretation of the rules. I think they are correct and advice is based on fair use for both the buyer and the artist/stock company, but I can not rule out that this interpretation is wrong.)
